Trade-Only Auction Status

All auctions conducted by Infinity Auctions Network ("Infinity Auctions" or "we") are operated strictly as trade-only auctions. Participation is limited to registered business entities or individuals acting in the course of business. By participating in our auctions, you ("Buyer") acknowledge and accept that these are not consumer sales, and as such, the transaction does not constitute a business-to-consumer contract.

Consumer protection legislation does not apply. This includes, but is not limited to:

  • Sale of Goods Act 1979
  • Consumer Rights Act 2015
  • Unfair Contract Terms Act 1977
  • Unfair Terms in Consumer Contracts Regulations 1999
  • Distance Selling Regulations
  • Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013

By bidding, you expressly agree that the above legislation is excluded, and you will not rely on any statutory warranties or implied conditions arising under such laws.

Participants are expected to have conducted their own research and due diligence and to have thoroughly inspected any lots they intend to bid on. The auctioneer and vendor make no warranties, guarantees or representations as to the condition, suitability, or fitness for purpose of any item.

By registering and bidding, the account holder acknowledges full acceptance of Infinity Auctions Network's Terms and Conditions of Sale and agrees to indemnify the auctioneer and vendor against any claims arising from the purchase.

 

Formation of a Legally Binding Contract

By participating in any Infinity Auctions Network auction and placing a bid, you acknowledge and agree to the following contractual terms:

  1. Contractual Agreement Upon Winning a Lot
    If your bid is accepted, a legally binding contract is formed between you (the bidder) and the seller. This agreement is governed by these Terms of Sale and any specific conditions listed for the lot.
  2. Offer and Acceptance
    • Each auction listing is an invitation to treat, not a contractual offer by the seller.
    • By placing a bid, you make a binding offer to purchase the lot.
    • A contract is formed only when the auction concludes and you are declared the winning bidder, at which point you are legally obliged to complete the purchase.
  1. Consideration
    • You agree to pay the final hammer price, including any applicable buyer’s premiums, fees, and taxes.
    • In return, the seller agrees to transfer ownership of the lot as described. This mutual exchange of value constitutes valid legal consideration.
  1. Intention to Create Legal Relations
    • By bidding, both you and the seller confirm your intention to enter into a legally binding agreement.
  1. Binding Nature of Terms and Conditions
    • By registering, ticking a box, clicking "I agree," or otherwise indicating your acceptance, you confirm that you have read, understood, and agree to be legally bound by these terms.
    • These terms form an integral part of the contract formed at the conclusion of a successful bid.

Please ensure you fully understand these obligations before bidding. Failure to complete a purchase in accordance with these terms may result in legal enforcement, financial penalties, or other contractual remedies.

Condition and Suitability of Lots

All lots are offered on an “as seen, where lying” basis, subject to not having been sold or withdrawn, and without any express or implied warranties. No representation is made that any lot is worthy, mechanically sound, or maintained to any particular standard. Lots may be unsuitable for use and may require substantial repairs at the buyer’s own expense. Buyers should be aware that some lots may not be of satisfactory quality.

Our Role as Auctioneers and Agents

Infinity Auctions Network operates solely as an agent acting on behalf of the vendor (seller). All descriptions, specifications, and representations relating to lots are provided in good faith based on information supplied by the vendor. While we make every effort to present information accurately, we do not warrant or guarantee the correctness, completeness, or reliability of any lot descriptions or accompanying documentation. Buyers are strongly advised to carry out their own independent inspections and verifications prior to bidding.

Pre-Bid Inquiries & Buyer Due Diligence

It is the sole responsibility of the bidder to carry out all necessary research, inspections, and inquiries prior to placing any bid. Infinity Auctions Network and its vendors offer all lots on an “as seen, where lying” basis, with no guarantees or warranties as to condition, completeness, or suitability. Bidders must ensure they are fully satisfied with the lot before making a binding commitment.

All questions, clarifications, or inspection requests must be made well in advance of bidding, including (but not limited to):

  • Verifying the lot’s status, specifications, or mechanical history (if relevant).
  • Requesting further images or documentation (where available).
  • Confirming VAT applicability on the hammer price and buyer’s premium.
  • Understanding collection requirements, transport limitations, and associated costs.
  • Clarifying any legal, compliance, or export issues if relevant to your purchase.

Once a bid has been submitted, no further queries, negotiations, or bid withdrawals will be accepted. Placing a bid signifies your unconditional agreement to purchase the lot in its present state, regardless of any subsequent discoveries.

All bidders are strongly advised to inspect lots in person wherever possible or to engage an agent or suitably qualified third party to do so on their behalf. Infinity Auctions Network will not be held liable for a buyer’s failure to make adequate pre-bid enquiries.

 

Bidding – Legal Commitment and Binding Nature

All bids placed during an Infinity Auctions Network auction are deemed to be legally binding and irrevocable. By submitting a bid, you enter a firm legal obligation and confirm the following:

  • You have read, understood, and agreed to be bound by the full terms and conditions of sale issued by Infinity Auctions Network.
  • You are acting in the capacity of a business entity or individual in trade and are legally entitled to enter into commercial transactions.
  • You acknowledge that bids cannot be cancelled, amended, or withdrawn under any circumstances, including errors or changes of intention.

Each bid constitutes a firm and unconditional offer to purchase the lot in its existing state, subject to the terms stated in the listing. If your bid is accepted — either by meeting or exceeding the reserve price, or by vendor approval of a lower bid — a legally enforceable contract of sale is formed between you and the vendor.

Bidders are therefore strongly advised to exercise due diligence before placing any bid. Once submitted, a bid may result in a binding transaction that is enforceable by law and subject to legal remedies in the event of breach or non-compliance.

Bid to Buy – Reserve Prices, Vendor Acceptance & Bid Validity

All bids submitted during an Infinity Auctions Network auction are presented to the vendor for consideration, regardless of whether the stated reserve price has been met.

In situations where the reserve price is not achieved, the vendor retains the discretion to accept a lower bid. If the vendor accepts your bid, even if it was not the highest, you will be deemed the successful purchaser, and a legally binding contract will be formed. As such, it is important to understand that you do not need to be the highest bidder to win a lot.

All bids placed during the auction will remain open and valid for a period of up to 24 hours after the auction has closed, during which time the vendor may decide whether to accept or reject them. Bidders are therefore expected to honour their bids during this window and should not place a bid unless they are fully prepared to proceed with the purchase.

Vendors are under no obligation to accept any bid, and acceptance remains entirely at their discretion. Infinity Auctions Network acts solely as an agent and does not influence the vendor’s decision.

All bids are considered final, binding, and legally enforceable. By placing a bid, you acknowledge that it constitutes a firm offer to purchase the lot on the terms stated, and that acceptance of your bid at any point within the 24-hour post-auction period will result in a contract of sale.

 

Vehicles and Machinery – Legal Notice

The Seller expressly disclaims any and all representations as to the accuracy, completeness or reliability of the information provided in relation to any Lot, whether such information is conveyed orally, in writing, or through digital imagery. All such information is provided for general reference only and is not to be relied upon by the Buyer in determining whether to place a bid or in assessing the value or condition of a Lot.

Without limitation, such information may include: manufacturing year, make and model, physical or mechanical condition, type and extent of damage, roadworthiness, drivability, accessories, mileage, odometer readings, vehicle identification numbers (VIN), title or registration status, required repairs, estimated repair costs, repair history, title history, service history and any records of previous write-offs or total losses.

The Seller gives no warranty, guarantee or undertaking—whether express or implied, oral or written—concerning the condition, completeness, suitability or compliance of any Lot with any applicable laws, including but not limited to environmental regulations, road safety requirements, or emissions standards. The Buyer acknowledges and accepts that any Lot offered for sale may be incomplete, inoperative, or in need of substantial repair or modification at the Buyer’s own expense.

It is the sole responsibility of the Buyer to conduct their own due diligence, including all necessary enquiries, inspections, assessments, and investigations, to satisfy themselves as to the nature and condition of the Lot, prior to placing any bid. By placing a bid, the Buyer confirms that they have had adequate opportunity to do so and are bidding with full knowledge of the risks involved.

No representation is made, and no warranty is given, as to the accuracy of any odometer reading. Where mileage is described as “verified”, such verification is based solely on the information available to the Seller at the time of listing and is provided as a guide only. Unless explicitly stated as “warranted”, no mileage reading shall be deemed accurate or reliable for any purpose.

The Seller acknowledges that expectations regarding the condition of used vehicles and machinery may vary between bidders. Accordingly, all Lots are presented with a selection of images supplied by the seller from their location. In instances where multiple identical or similar Lots are offered, library images may be used. No claim or recourse shall be available in respect of any damage, defect or imperfection visible in such images which the Buyer failed to review or properly consider prior to bidding.

Wear and tear consistent with the age, mileage and typical usage of the item—including, but not limited to, cosmetic damage such as scratches, dents, cracks, corrosion or paint defects—shall not constitute grounds for complaint. Such conditions are presumed and do not affect the basic assumption that the Lot is sold as requiring repair or attention.

All descriptions of Lots are provided in good faith, based on the Seller’s knowledge and the information available at the time of listing. These descriptions are intended solely for general guidance and shall not form part of any contractual representation. The Seller reserves the right to amend or update Lot descriptions prior to the conclusion of the auction should further information come to light. It is a condition of bidding that prospective Buyers make their own enquiries in respect of any matter material to their purchasing decision, including but not limited to dimensions, mileage, usage hours, provenance and authenticity.

Lots are available for physical inspection strictly by prior appointment, and the Seller strongly encourages all potential Bidders to conduct a thorough inspection of any Lot prior to placing a bid. The Buyer acknowledges that they have had a reasonable opportunity to inspect and evaluate the Lot, and that any failure to do so shall not give rise to any right of cancellation, claim, return or compensation post-sale. Inspection is undertaken entirely at the Buyer’s own risk, and the Seller shall accept no liability in relation thereto.

No reliance shall be placed upon photographs, written descriptions, verbal statements or any other marketing material in lieu of personal inspection. If a Lot is purchased without prior inspection, the Buyer does so entirely at their own risk.

All Lots are sold on the basis that they may require rectification, repair, or maintenance, and that they may not be fit for any specific or intended purpose. By bidding, the Buyer confirms that they have considered and accepted all risks as set out in these terms and conditions, and that their bid reflects those risks accordingly.

1.0. Bidding and Registration

1.1. Account Registration and Eligibility

1.1.1. Prior to participating in any auction conducted by Infinity Auctions Network ("the Auctioneer"), prospective bidders must first create a bidding account through the designated registration platform.

1.1.2. Upon successful creation of a bidding account, the registrant may apply to bid in specific auctions. Registration does not guarantee approval, and all applications remain subject to the Auctioneer’s review and approval process.

1.2. Approval and Right to Refuse Registration

1.2.1. The Auctioneer retains the absolute and unfettered discretion to approve or decline any bidder registration, without obligation to provide reasons. Manual approval may be required prior to the activation of bidding privileges.

1.2.2. Infinity Auctions Network reserves the right to suspend, restrict, or terminate bidding privileges at any time where it deems appropriate, including but not limited to circumstances involving suspected fraudulent activity, breach of terms, or failure to meet verification requirements.

1.3. Verification of Identity

1.3.1. The individual identified as the ‘Account Holder’ may be required to submit additional documentation or information for the purposes of identity verification and security compliance. This may be a condition precedent to participation in any auction.

1.3.2. Acceptable forms of verification may include, but are not limited to, a current and valid full UK Driving Licence, a recent utility bill (dated within the last 3 months), a passport, or other official government-issued identification.

1.4. Agreement to Terms and Conditions

1.4.1. As part of the registration process, the Account Holder shall be required to acknowledge and accept the Auctioneer’s Terms of Sale and Terms and Conditions of Bidding and Purchase. By completing registration, the Account Holder is deemed to have read, understood, and accepted such terms in their entirety.

1.5. Binding Nature of Bids

1.5.1. All bids placed, whether via the online bidding platform or through any authorised bidding channel, shall be considered irrevocable, unconditional, and legally binding offers to purchase the lot in question.

1.5.2. Under no circumstances may a bid be withdrawn, amended, or cancelled once submitted. By placing a bid, the bidder confirms that they have the authority and capacity to enter into a legally binding contract of sale.

1.6. Responsibility for Bidding Activity

1.6.1. The Account Holder shall bear sole and full responsibility for all bidding activity conducted through their account, whether executed personally or by any party acting with their authority or under their credentials.

1.6.2. In the event of a successful bid—whether it results in a confirmed sale or a provisional acceptance—the Account Holder irrevocably agrees to complete the purchase of the lot(s) in accordance with the applicable sale terms, including the payment of any associated fees, taxes, and charges.

1.7. Age Requirement

1.7.1. By registering for a bidding account, the Account Holder affirms and warrants that they are eighteen (18) years of age or older and possess full legal capacity to enter into binding contracts under the laws of England and Wales (or relevant UK jurisdiction).

2.0. Payment Terms and Conditions

2.1. Binding Obligation to Pay

2.1.1. Upon the conclusion of the auction and acceptance of a successful bid, the Buyer shall be deemed to have entered into a legally binding contract of sale with the individual or entity legally owning the Lot(s) in question (“the Seller”), which is enforceable by Infinity Auctions Network acting on behalf of the seller.

2.1.2. Infinity Auctions Network Ltd, acting on behalf of the Seller and with their express authorisation, is duly appointed to administer the collection of payment. The Buyer shall remit payment in full to Infinity Auctions Network Ltd, who is authorised to receive such funds as agent for the Seller.

2.1.3. The Buyer shall be under an immediate and irrevocable obligation to settle the total amount due for the Lot(s) awarded, including but not limited to:

  • the hammer price;
  • any applicable Buyer’s Premium;
  • administrative or documentation charges;
  • value added tax (VAT); and
  • any other fees or surcharges identified in the sale documentation.

2.1.4. Unless otherwise agreed in writing, all sums due must be paid in full and in cleared funds within twenty-four (24) hours of the conclusion of the auction or the notification of a successful bid, whichever occurs later. Time is of the essence in respect of this obligation.

2.1.5. Failure to remit payment within the specified period may result in the following consequences being imposed, at the sole discretion of Infinity Auctions Network Ltd acting on behalf of the Seller:

  • cancellation of the sale.
  • forfeiture of any deposit or advance payment made.
  • imposition of late payment charges, interest, or storage fees.
  • suspension or permanent restriction of the Buyer’s bidding privileges in current and future auctions; and/or
  • commencement of legal proceedings for recovery of all outstanding sums and any resulting losses or damages.

2.2. Accepted Methods of Payment

2.2.1. Payment must be made by electronic bank transfer only. Payments by cash, cheque, credit/debit card, or via third-party platforms (e.g. PayPal) are not accepted under any circumstance by Infinity Auctions Network Ltd.

2.2.2. The Buyer shall bear full responsibility for ensuring that the total invoiced amount is received in cleared funds without deduction, including deductions for bank charges, exchange fees, or transfer costs.

2.3. Bank Account Details for Payment

All payments must be made directly to the following bank account held by Infinity Auctions Network Ltd, who is authorised to collect payment on behalf of the Seller:

2.4. Allocation and Confirmation of Payment

2.4.1. The Buyer must ensure that the payment reference includes either the invoice number or registered account name to facilitate correct allocation of funds.

2.4.2. A copy of the remittance advice or payment confirmation must be submitted promptly to Infinity Auctions Network Ltd once the transaction has been initiated.

2.4.3. Legal title in the Lot(s) shall not pass to the Buyer until such time as full and cleared payment has been received and acknowledged by Infinity Auctions Network Ltd, acting in its capacity as payment collection agent on behalf of the Seller.

2.5. Bidding Commitment and Payment Obligation

Bidders are reminded that by placing a bid, they have entered into a legally binding commitment to purchase the lot(s) if successful. Bids should only be placed where the bidder has the means and intent to comply fully with the auction’s terms and conditions, including prompt payment within the specified deadline.

2.6. Post-Payment Release of Contact Details and Documentation Handling

Upon receipt of full and cleared payment, Infinity Auctions Network will provide the seller’s contact details to the buyer via the email address associated with their bidding account. It is then the buyer’s responsibility to liaise directly with the seller to arrange collection of the lot(s).

Buyer information will always be past to the seller and to verify at point of collection.

In the case of vehicle sales or any other lots where documentation transfer is required, the buyer’s contact information (such as name and email address) will be forwarded to the seller solely for the purpose of facilitating the transfer of ownership documents or registration paperwork.

Please note:

  • Seller details will only be released to the buyer after payment has been received in full.
  • Buyer details will always be released for the seller to verify upon collection
  • Both parties are expected to handle documentation promptly and in accordance with applicable laws or regulatory requirements.

This process ensures proper transfer of title and compliance with trade practices while maintaining appropriate data handling standards.

2.7. Documentation, Spare Keys & Additional Items

Please note that any documentation, spare keys, accessories, or other items referenced in the lot listing are provided directly by the seller. These items are not held or handled by Infinity Auctions Network at any stage.

It is the buyer’s sole responsibility to ensure that any such items are collected directly from the seller at the time of collection. Infinity Auctions Network accepts no liability for the availability, completeness, or condition of these items and shall not be held responsible for any failure by the seller to provide them.

Buyers are strongly advised to verify with the seller at the point of arranging collection that all expected items are ready to be handed over.

3.0. Reserve Prices and Provisional Bids

3.1. Amendment of Reserve Prices

3.1.1. The Vendor reserves the right to amend or withdraw the reserve price attached to any Lot(s) at any time, whether prior to, during, or following the conclusion of the auction. Such amendments may be made at the sole discretion of the Vendor and without notice to prospective bidders.

3.2. Submission of Bids Below Reserve

3.2.1. In circumstances where a Lot has received bids during the auction but has not met the reserve price, the Account Holder hereby grants express authorisation to Infinity Auctions Network Ltd ("the Auctioneer"), acting on behalf of the Vendor, to submit the highest bid placed by the Account Holder for post-sale consideration by the Vendor.

3.3. Post-Auction Acceptance of Bids

3.3.1. Where the Vendor elects to accept a bid submitted in accordance with Clause 3.2, such acceptance must occur within twenty-four (24) hours of the conclusion of the auction.

3.3.2. Upon the Vendor’s acceptance of the bid, the Account Holder shall be deemed to have entered into a binding contract of sale. A formal invoice shall be issued by the Auctioneer without undue delay, and the Account Holder shall settle the full invoiced amount no later than 5:00 PM on the next business day. Time shall be of the essence in respect of this payment obligation.

3.4. Consideration of All Bids – Not Limited to the Highest Bidder

3.4.1. The Account Holder acknowledges and accepts that being the highest bidder during the auction does not guarantee acceptance of the bid or entitlement to purchase the Lot.

3.4.2. The Auctioneer, acting on behalf of the Vendor, reserves the right to submit any and all bids to the Vendor for assessment, regardless of their relative position or value. The Vendor may, at their sole discretion, consider a number of factors in determining whether to accept a bid, including but not limited to:

  • the length of time the Account Holder has maintained a registered account with the platform.
  • the Account Holder’s past payment history and record of compliance with payment deadlines.
  • any prior suspensions, bidding restrictions, or permanent blocks imposed by this platform or affiliated auctioneers.
  • the perceived reliability and conduct of the Account Holder.

3.4.3. Accordingly, the Vendor is under no obligation to accept the highest bid. All bids remain open for consideration for a period of twenty-four (24) hours after the auction concludes.

3.5. Acceptance of Maximum Bid

3.5.1. Where an Account Holder has submitted a ‘Maximum Bid’ (defined as the highest price they are willing to pay for a Lot), and the Vendor subsequently elects to accept that bid within twenty-four (24) hours following the close of the auction, the Auctioneer shall notify the Account Holder accordingly.

3.5.2. The Account Holder shall then receive a winning invoice indicating the Lot(s) secured and the total amount payable. The invoice shall specify the payment deadline, which shall be binding in accordance with Clause 3.3.2.

3.6. Role of the Auctioneer and Limitation of Responsibility

3.6.1. Infinity Auctions Network Ltd acts solely as an authorised agent for the Vendor in facilitating the auction process, administering bid submissions, and collecting payment where applicable. The Auctioneer does not hold title to any Lot, nor does it assume any responsibility or liability for the Vendor’s decisions in accepting, rejecting, or declining bids.

3.6.2. The Vendor remains the principal party to the contract of sale, and the acceptance of any bid—whether during the auction or in the post-sale period—is entirely at the discretion of the Vendor. No guarantee is given, express or implied, that any bid (regardless of value or ranking) will be accepted, nor that any Lot will ultimately be sold.

3.6.3. By placing a bid, the Account Holder acknowledges and agrees that the Auctioneer’s role is limited to administrative facilitation, and that no cause of action shall arise against the Auctioneer in the event that the Vendor elects not to proceed with a sale.

3.7. Marketing Consent – Auction Focus Media

3.7.1. By registering for and participating in any auction administered by Infinity Auctions Network Ltd, you expressly agree to receive marketing communications from Auction Focus Media, a third-party promotional platform which advertises auctions on behalf of affiliated auctioneers, including this one.

3.7.2. These communications may include, but are not limited to, notifications regarding upcoming auctions, featured listings, special promotions, or relevant industry news.

3.7.3. You may, at any time and without cost, opt out of receiving such communications by using the unsubscribe link or instructions provided in any message received from Auction Focus Media.

3.7.4. Your acceptance of these terms shall constitute your informed consent to receive such marketing communications unless and until you exercise your right to unsubscribe.

4.0. Lot End Times and Lot Availability

4.1. Right to Withdraw or Remove Lots

4.1.1. Infinity Auctions Network Ltd reserves the absolute and unrestricted right to withdraw, remove, or otherwise modify any Lot listed for sale at any time and for any reason, without obligation to notify the Account Holder or any other party in advance. Such action may be taken at the sole discretion of the Auctioneer and shall not give rise to any liability or claim for compensation.

4.2. Modification of Lot End Times in Timed Auctions

4.2.1. In respect of Timed Auctions, Infinity Auctions Network Ltd retains the right to amend, postpone, or extend the designated closing time of any Lot without prior notice. This may include but is not limited to system-generated extensions resulting from late bidding activity. 

4.3. Availability of Lots Post-Auction

4.3.1. While all Lots are available at the time of listing, Infinity Auctions Network Ltd makes no warranty or representation that any Lot shall remain available after the conclusion of the auction. Circumstances beyond the control of the Auctioneer, including actions or omissions by the Vendor, may affect post-auction availability.

4.4. Limitation of Liability for Unavailable Lots

4.4.1. Infinity Auctions Network Ltd shall not be held liable in any manner where a Lot becomes unavailable after the close of the auction. This includes but is not limited to instances where the Lot has been:

  • lost;
  • damaged;
  • otherwise withdrawn by the Vendor; or
  • rendered unavailable due to third-party actions or events outside the Auctioneer's reasonable control.

4.5. Exclusion of Claims Arising from Lot Unavailability

4.5.1. No claims or complaints shall be entertained by Infinity Auctions Network Ltd in relation to the unavailability or non-supply of any Lot following the auction, regardless of whether or not a winning bid was placed.

4.6. Buyer Remedy for Paid but Unavailable Lots

4.6.1. In the event that a Buyer has made full payment for a Lot which subsequently becomes unavailable for any reason, Infinity Auctions Network Ltd, acting on behalf of the Seller, shall issue a full refund of the invoice amount paid for that specific Lot.

4.6.2. For the avoidance of doubt, this refund obligation applies strictly to the Lot itself and shall not extend to any associated items or accessories that may be missing or unavailable at the time of collection or delivery. Such associated items may include, but are not limited to:

vehicle keys;

registration documents (e.g. V5C);

service history records;

invoices or receipts;

user manuals or handbooks;

original accessories or tools.

4.6.3. The absence of any such supplementary items shall not entitle the Buyer to a refund, price reduction, compensation, or cancellation of the sale, unless expressly agreed otherwise in writing prior to the conclusion of the transaction.

4.6.4. The refund of the Lot price under this clause shall constitute the sole and exclusive remedy available to the Buyer in respect of post-sale unavailability, and no further claims for damages, consequential loss, or costs shall be entertained.

4.7. Automatic Extension of Closing Time

4.7.1. Where a bid is placed on a Lot during the final ten (10) minutes prior to its scheduled closing time, the auction system will automatically extend the Lot’s end time by up to ten (10) additional minutes. This mechanism may repeat for each subsequent bid placed within the final ten minutes to ensure fair bidding opportunities.

4.8. Collection, Risk and Transfer of Responsibility

4.8.1. Unless otherwise agreed in writing, the Buyer shall be responsible for arranging the collection of any purchased Lot(s) within seven (7) days of the auction’s conclusion or notification of availability. Collection is strictly by appointment only, and may be subject to the operational constraints of the Seller or the location where the Lot is held.

4.8.2. The Buyer shall be solely responsible for all arrangements relating to the collection, transport, loading, insurance, and legal compliance in relation to the Lot. This includes adherence to relevant laws and regulations applicable to the movement and use of the Lot.

4.8.3. Risk in the Lot shall pass to the Buyer at the earlier of:

  • the moment the Lot is physically collected by the Buyer or their authorised agent; or
  • the point at which the Buyer fails to collect the Lot within the specified collection window, in which case risk transfers upon expiry of the collection deadline.

4.8.4. From the point at which risk passes, Infinity Auctions Network Ltd and the Seller accept no liability whatsoever for loss, theft, or damage to the Lot, regardless of cause. Buyers are strongly advised to obtain adequate insurance coverage once risk has transferred.

4.8.5. Legal title to the Lot shall not pass to the Buyer until full and cleared payment has been received in accordance with Clause 2.0. Until that time, the Seller retains full legal and beneficial ownership.

4.8.6. Failure to collect a Lot within the specified timeframe may result in the imposition of storage charges, removal fees, or administrative penalties. Continued non-collection may result in the resale or disposal of the Lot at the Buyer’s risk and expense, without further notice.

4.9. Storage Charges and Abandonment

4.9.1. Infinity Auctions Network Ltd, acting on behalf of the Seller, reserves the right to apply a daily storage charge for any Lot(s) not collected within the period specified in Clause 4.8.

4.9.2. The storage charge shall be calculated as the greater of:

  • 5% of the Hammer Price per Lot, plus VAT, or
  • £20.00 plus VAT per day.

4.9.3. Storage charges are incurred on a daily calendar basis, including Saturdays, Sundays, and UK bank holidays, without exception.

4.9.4. The above charges shall be applied individually per Lot and shall continue to accrue until the Lot is collected or otherwise dealt with in accordance with these terms.

4.9.5. No Lot(s) shall be released for collection or delivery until all outstanding storage charges and associated fees have been paid in full and cleared funds have been received by Infinity Auctions Network Ltd.

4.9.6. If any Lot(s) remain uncollected for more than twenty (20) days from the date collection details were provided, the Lot(s) shall be deemed abandoned by the Buyer.

4.9.7. Upon abandonment, full legal and beneficial ownership shall transfer to Infinity Auctions Network Ltd, who may retain, resell, dispose of, or otherwise deal with the Lot(s) at its absolute discretion and without further notice.

4.9.8. No refund, credit, or compensation shall be due to the Buyer for any Lot(s) deemed abandoned, and the Buyer shall remain liable for all accrued storage charges and any related costs incurred prior to the date of abandonment.

6.0. VAT Charges

6.1. Standard VAT Application

6.1.1. Unless otherwise specified in the individual Lot description, VAT at the standard UK rate of 20% shall apply to:

  • the Hammer Price.
  • the Buyer’s Premium; and
  • any other applicable fees or surcharges (including Internet Surcharges).

6.1.2. All applicable VAT charges shall be clearly itemised on the Buyer’s invoice.

6.2. VAT Exceptions on Hammer Price

6.2.1. Certain Lots may be offered for sale without VAT on the Hammer Price, typically under margin schemes or as zero-rated supplies. These exceptions will be clearly stated in the individual Lot description.

6.2.2. Buyers are advised to review the Lot details carefully and seek professional tax advice if necessary, especially where the VAT treatment of a Lot may impact their business operations or recovery position.

7.0. Export Sales and VAT Refunds

7.1. Export Deposit Requirement

7.1.1. Buyers intending to export any Lot(s) purchased from Infinity Auctions Network Ltd shall be required to pay an additional deposit equivalent to the amount of UK VAT that would otherwise be payable on the Hammer Price of each applicable Lot.

7.1.2. This export VAT deposit shall be held pending submission of valid and sufficient export documentation in compliance with HMRC regulations confirming that the Goods have been exported outside the United Kingdom.

7.2. Evidence Required for VAT Refunds

7.2.1. In order to qualify for a refund of the VAT deposit, the Buyer must ensure that:

  • the Goods are exported from the United Kingdom in full compliance with current HMRC export requirements; and
  • valid, written evidence of such export is submitted within twenty-eight (28) days from the date of the relevant invoice.

7.2.2. Acceptable evidence must be submitted to the Auctioneer via email at:

7.2.3. The Auctioneer acts solely as a facilitator in the transaction and does not assume ownership of any Goods sold. As such, the Auctioneer does not accept any liability or responsibility for the processing, outcome, or validity of VAT refunds, unless such responsibility has been explicitly agreed in writing by all parties prior to the sale.

7.3. Forfeiture of VAT Deposit

7.3.1. If sufficient and satisfactory export evidence is not provided within twenty-eight (28) days of the invoice date, the Goods shall be deemed to have been supplied for domestic use within the United Kingdom.

7.3.2. In such circumstances, the Buyer shall forfeit the VAT deposit paid under Clause 7.1 and shall have no right to reclaim, dispute, or recover such amount.

7.4. VAT on Buyer’s Premium

7.4.1. VAT charged on the Buyer’s Premium, Internet Surcharge, and any other service-related fees is non-refundable under any circumstances, including in cases of export.

7.5. Auctioneer’s Right to Refuse Bids or Sales

7.5.1. Notwithstanding any other provision in these terms and conditions, Infinity Auctions Network Ltd reserves the absolute right, at its sole discretion, to:

  • refuse to accept any bid from any individual or entity; and/or
  • refuse to sell any Lot, in whole or in part, to any Buyer, without obligation to provide justification or reason.

7.6. Buyer Responsibility for Export Documentation

7.6.1. Infinity Auctions Network Ltd does not arrange shipping or export documentation. However, upon request, and where reasonably possible, we may include additional details on invoices (such as commodity codes, weights, or descriptive information) to assist Buyers in completing export formalities.

7.6.2. It is the sole responsibility of the Buyer to request and provide any specific export-related information to be included on the invoice. Infinity Auctions Network Ltd accepts no responsibility or liability for:

  • the accuracy or completeness of such information;
  • any omissions or delays;
  • or any legal, regulatory, or financial consequences resulting from incorrect or incomplete export declarations.

8.0. Viewing of Lots

8.1. Encouragement to View Prior to Bidding

8.1.1. Infinity Auctions Network Ltd strongly advises all prospective Buyers to arrange and conduct a physical inspection of any Lot(s) prior to placing a bid.

8.1.2. All Lots are sold without warranty, guarantee, or post-sale inspection rights, and it is the Buyer’s sole responsibility to satisfy themselves as to the condition, accuracy of description, completeness, and suitability of any Lot before bidding.

8.2. Viewing by Appointment Only

8.2.1. Viewings are available strictly by prior appointment, at the discretion of Infinity Auctions Network Ltd or the Seller and must take place before the auction concludes.

8.2.2. No viewings will be permitted after the close of the auction, and no allowances will be made for Bidders who fail to attend a viewing when such an opportunity was offered.

8.3. No Post-Auction Inspection Contingency

8.3.1. For the avoidance of doubt, a winning bid is not conditional upon, nor subject to, any post-auction viewing or inspection.

8.3.2. By placing a bid, the Bidder confirms that they have either:

  • inspected the Lot prior to bidding; or
  • waived their right to do so.

8.3.3. No refunds, cancellations, price adjustments, or complaints shall be considered on the basis that the Lot was not viewed prior to bidding or that it did not meet post-auction expectations.

9.0. Description Accuracy

9.1. General Disclaimer on Lot Descriptions

9.1.1. Infinity Auctions Network Ltd, acting as agent for the Seller, provides descriptions and imagery of Lots based on information furnished by the Seller at the time of listing.

9.1.2. While such information is provided in good faith, no representation, warranty, or guarantee—express or implied—is made as to the accuracy, completeness, or reliability of any description.

9.1.3. Buyers are strongly advised to carry out their own inspections and enquiries prior to bidding and to not rely solely on description text, photographs, or verbal communications when deciding whether to bid or determining the bid amount.

9.2. Buyer Responsibility for Due Diligence

9.2.1. All Lots are sold strictly "as seen" and "where lying", with no guarantees or warranties, whether expressed or implied, as to their condition, roadworthiness, completeness, or fitness for any particular purpose.

9.2.2. It is the responsibility of each Account Holder to conduct all necessary due diligence, including physical inspection, investigation, and independent verification of any critical information.

9.3. Images and Mileage/Hour Disclaimers

9.3.1. Lot images are supplied by the Seller and are representative of the item at the time of listing. In some cases, library images may be used where multiple similar items are being offered.

9.3.2. Any odometer or usage hour readings listed are not deemed to be warranted unless specifically stated as “warranted” in the Lot description.

9.3.3. Even where mileage is marked “verified,” this is based solely on available data at the time of listing and is provided as guidance only, not as a guarantee.

9.4. Limitations of Visual Descriptions

9.4.1. Descriptions may include (but are not limited to): year, make, model, specification, mileage, damage type, roadworthiness, service history, title or registration, accessories, VIN, and repair history. This information is not to be relied upon as accurate, complete, or

9.4.2. Buyers may have differing expectations regarding condition. No claims will be considered for any defects or issues — whether visible in the images or not — if the bidder did not examine the lot carefully prior to bidding.

9.4.3. Minor cosmetic defects—such as scratches, dents, cracked or broken plastics/glass, paint defects, or rust—are to be expected and shall not be regarded as material or grounds for complaint.

9.5. Legal Exclusion of Implied Terms

9.5.1. You acknowledge and agree that Infinity Auctions Network Ltd and the Seller expressly exclude, to the fullest extent permitted by law, any liability that might otherwise arise under the Sale of Goods Act 1979 (as amended), including—without limitation—any implied terms relating to:

  • conformity with description;
  • satisfactory quality;
  • or fitness for a particular purpose.

9.6. No Post-Sale Allowances or Claims

9.6.1. No post-sale allowances, refunds, returns, or complaints shall be accepted for:

  • condition or defects discoverable upon inspection;
  • failure to carry out due diligence;
  • or dissatisfaction with the Lot following purchase.

9.6.2. Bidders are deemed to have had the opportunity to inspect the Lot prior to bidding, and all Lots are sold on the understanding that repairs or attention may be required.

9.6.3. By placing a bid, you confirm that you accept all risks associated with the purchase and have bid accordingly.

9.7 – Vehicle History, Title & Finance Checks

9.7.1. Infinity Auctions Network Ltd undertakes a basic VDI (Vehicle Data Integrity) check on each vehicle to ensure it is not reported as stolen, and to identify whether it is listed as an insurance write-off or subject to any outstanding finance agreements, based on data available at the time of listing.

9.7.2. While reasonable efforts are made to provide accurate information, all VDI checks are based on third-party data, and Infinity Auctions Network Ltd cannot guarantee the accuracy, completeness, or current status of the information retrieved.

9.7.3. Buyers are still strongly encouraged to perform their own independent checks, especially where finance, accident history, or title status are deemed material to their purchase decision.

9.7.4. In the event that outstanding finance or title issues are discovered after purchase, the Buyer must pursue resolution directly with the Seller, as Infinity Auctions Network Ltd is not a party to the contract of sale and disclaims all liability in such matters.

10.0. Lot Images

10.1. Source of Images

10.1.1. All images associated with a Lot are provided by the Seller at the time of listing. Infinity Auctions Network Ltd does not independently verify the accuracy or recency of such images.

10.2. Images for Guidance Only

10.2.1. Images are provided strictly for general guidance and illustrative purposes only. They should not be relied upon as a definitive representation of a Lot’s actual condition, specification, or completeness.

10.2.2. No claim, refund, or cancellation will be entertained on the grounds that a Lot does not conform precisely to its photographic representation.

10.3. Use of Stock or Library Images

10.3.1. Where a listing is marked as containing “Stock Images” or “Library Photographs”, these are used purely for illustration and may not depict the actual Lot being sold.

10.3.2. It is the Buyer’s responsibility to enquire, inspect, or request additional information before bidding, particularly where a stock image has been used.

11.0. Registration Plates

11.1. Due Diligence Responsibility

11.1.1. Where a vehicle’s registration plate is visible in any Lot image, it is the Account Holder’s sole responsibility to conduct their own due diligence using that registration number—such as for checking MOT status, previous ownership, insurance history, or mileage. 

11.2. Private Registration Numbers

11.2.1. Certain Lots may be displayed or described as having a private registration number. In such cases, it is the Account Holder’s responsibility to confirm whether the private plate is included in the sale.

11.2.2. No private registration number is deemed to be included unless this is explicitly stated in the Lot description. Inclusion shall not be inferred based solely on imagery or verbal representation.

12.0. Delivery

12.1. No Delivery Service by the Auctioneer

12.1.1. Infinity Auctions Network Ltd, acting as the auctioneer, does not provide delivery services for any Lot sold. Delivery, if available, is offered solely by the Seller and does not form part of the auction sale contract.

12.2. Delivery Availability and Quotes

12.2.1. Where a Lot listing states that “delivery is available”, this is information provided by the Seller at the time of listing and is for guidance only.

12.2.2. If requested prior to bidding, a non-binding delivery estimate may be provided, where feasible, for Lots that indicate delivery availability.

12.3. Post-Bid Delivery Requests

12.3.1. If a Buyer requests delivery after bidding, a quote may be obtained only after the Buyer has paid the full invoice amount relating to the Lot.

12.3.2. Upon full payment, Infinity Auctions Network Ltd may release the Seller’s contact details to the Buyer to allow direct arrangement of delivery.

12.3.3. All delivery costs must be paid directly to the Seller and do not form part of the auction invoice issued by the Auctioneer.

12.4. Disclaimer of Delivery Liability

12.4.1. Infinity Auctions Network Ltd accepts no liability whatsoever for:

  • the organisation, scheduling, or provision of delivery.
  • any delay, damage, or failure in delivery services.
  • or any resulting loss or inconvenience suffered by the Buyer.

12.4.2. Delivery is a separate arrangement between Buyer and Seller, and the Auctioneer shall not entertain any claims, disputes, or refund requests in connection with delivery-related issues.

13.0. Refunds / Buybacks / Renegotiations

13.1. No Right to Refund or Renegotiation

13.1.1. Infinity Auctions Network Ltd, acting on behalf of the Seller, makes it expressly clear that no refunds, buybacks, renegotiations, or financial contributions shall be offered under any circumstances once a Lot has been sold.

13.1.2. Buyers are reminded that all Lots are sold “as seen,” without warranty or guarantee, and that it is the sole responsibility of the Buyer to carry out all necessary enquiries, inspections, and due diligence prior to bidding.

13.1.3. Post-sale dissatisfaction—whether relating to condition, functionality, description accuracy, or fitness for purpose—shall not entitle the Buyer to a refund, price adjustment, cancellation, or any other remedy.

13.1.4. This policy is strictly enforced and applies to all sales without exception.

14.0. Termination of Auctions & Account Holders

14.1. Termination or Suspension of Auctions

14.1.1. Infinity Auctions Network Ltd reserves the absolute right to suspend, cancel, or terminate any auction or individual Lot listing at any time, without prior notice and without liability to any party.

14.2. Suspension or Termination of Account Access

14.2.1. The Company reserves the right, at its sole discretion, to suspend or terminate any Account Holder’s access to its platforms, bidding tools, or related services at any time, with or without notice.

14.2.2. Such action may be taken with immediate effect and without liability, including but not limited to cases involving suspected misuse, breach of terms, non-payment, abusive behaviour, or activity deemed prejudicial to the auction process. 

14.3. Temporary Account Restrictions

14.3.1. Infinity Auctions Network Ltd may impose temporary bidding restrictions or blocks on an Account Holder at any stage—before, during, or after any auction—where deemed appropriate, including where investigations are ongoing.

14.4. Permanent Account Bans

14.4.1. Infinity Auctions Network Ltd reserves the right to permanently exclude any Account Holder from future bidding activity across all auctions and platforms on which it operates.

14.4.2. Such action may be taken without further notice where, in the Company’s sole opinion, the Account Holder has engaged in serious misconduct, repeated breaches of terms, or conduct that undermines the integrity of the auction process.

15.0. Warranty and Liability

15.1. Infinity Auctions Network Ltd, acting solely as the auctioneer, is not a party to the contract of sale between the Buyer and the Seller (Vendor) and shall bear no liability for any act, omission, misrepresentation, or default of either party.

15.2. All Lot descriptions are provided based on information submitted by the Seller, and Infinity Auctions Network Ltd does not warrant or guarantee the accuracy, reliability, or completeness of any such information.

15.3. Auctions conducted by Infinity Auctions Network Ltd are trade-only auctions and are not subject to the Sale of Goods Act 1979, the Consumer Rights Act 2015, or any related consumer protection legislation. By bidding, the Account Holder expressly acknowledges and agrees to this exclusion.

16.0. Confidentiality and Non-Circumvention

16.1. All parties involved in the auction process shall treat any confidential information obtained or disclosed during the course of bidding or negotiation as strictly confidential, and shall not disclose such information to any third party without prior written consent.

16.2. Buyers are prohibited from circumventing Infinity Auctions Network Ltd by entering into any direct arrangement, contract, or negotiation with the Seller, consignor, or supplier of any Lot without the express written permission of Infinity Auctions Network Ltd.

17.0. Feedback and Disputes

17.1. Infinity Auctions Network Ltd values feedback for the purpose of enhancing its auction services. Any concerns or complaints should be addressed directly to Infinity Auctions Network Ltd via email or in writing.

17.2. Any feedback relating to a Seller should be communicated directly to the Seller and not posted publicly on any platform owned or operated by Infinity Auctions Network Ltd.

17.3. Infinity Auctions Network Ltd reserves the right to investigate and take appropriate action against any false, defamatory, or misleading feedback that may cause reputational damage or adversely affect its business.

18.0. Governing Law and Jurisdiction

18.1. These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales, being the jurisdiction in which Infinity Auctions Network Ltd is registered.

18.2. Any disputes or legal proceedings arising from or in connection with these Terms and Conditions shall be exclusively subject to the jurisdiction of the courts of England and Wales.

19.0. Amendments to Terms of Sale / Terms & Conditions

19.1. Infinity Auctions Network Ltd reserves the right to amend, revise, or update these Terms of Sale and/or Terms & Conditions at any time, without prior notice to Account Holders or prospective Bidders.

19.2. It is the responsibility of each returning Bidder or Account Holder to ensure that they review the latest version of the Terms and Conditions prior to participating in any auction. Continued use of the platform constitutes acceptance of any updated terms.

20.0. Auctioneer's Discretion and Vendor Rights

By participating in auctions conducted by Infinity Auctions Network Ltd, you acknowledge and agree that:

20.1. The Auctioneer may set and enforce a reserve price for any Lot, which shall remain confidential unless otherwise disclosed.

20.2. The Auctioneer may place bids on behalf of the Seller, up to the reserve price, in accordance with accepted auction practice.

20.3. The Seller may also bid on their own Lot(s), provided that such bidding does not exceed the reserve price.

20.4. The Auctioneer reserves the right to:

  • Withdraw any Lot from sale at any time, whether or not bidding has commenced;
  • Cancel a sale post-auction if necessary due to error, dispute, or other material reason;
  • Rearrange, consolidate, or alter the order of sale without notice or justification;
  • Refuse to disclose the reserve price, except where legally obligated.

21.0. Acceptance of Terms

By participating in any auction conducted by Infinity Auctions Network Ltd, whether by placing a bid, registering an account, or otherwise engaging with the auction platform, you confirm that you have:

  • Read,
  • Understood, and
  • Agreed to be bound by these Terms and Conditions.
